1. Agreement to Terms

By accessing and using CreateEnsemble ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access and use the Platform for personal, non-commercial creative and professional purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials except for your personal creative use
• Use the materials for any commercial purpose without explicit permission
• Attempt to decompile or reverse engineer any software contained on the Platform
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Violate any applicable laws or regulations
• Use the platform to discriminate against or harass other users

3. User Accounts and Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information in your profile
• Notifying us immediately of any unauthorized use of your account
• Respecting the intellectual property rights of other users
• Complying with our community guidelines and code of conduct

4. Content Ownership and Rights

You retain ownership of the creative content you upload to CreateEnsemble. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform for the purpose of providing our services. This includes:

• Displaying your portfolio and creative work
• Featuring your work in platform promotions
• Sharing your content with potential collaborators or employers
• Creating backups and ensuring platform functionality

5. Community Guidelines

CreateEnsemble is committed to fostering a respectful and inclusive creative community. Users agree to:

• Treat all community members with respect and dignity
• Refrain from discriminatory language or behavior
• Support and uplift fellow BIPOC creatives
• Provide constructive feedback when appropriate
• Report any violations of these guidelines
• Respect cultural differences and diverse perspectives

6. Prohibited Activities

You may not use the Platform to:

• Harass, intimidate, or discriminate against other users
• Upload content that infringes on intellectual property rights
• Share false or misleading information
• Engage in fraudulent or deceptive practices
• Upload malicious code or content that could harm the platform
• Impersonate other individuals or organizations
• Use the platform for illegal activities

7. Payment Terms

For paid services and subscriptions:

• All fees are non-refundable unless otherwise specified
• Subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time
• We reserve the right to change pricing with 30 days notice
• Late payments may result in service suspension

8. Intellectual Property

The CreateEnsemble platform, including but not limited to text, graphics, logos, images, and software, is the property of CreateEnsemble and is protected by international copyright laws. The creative content shared by our community members is protected by their respective intellectual property rights. You may not reproduce, distribute, or transmit any platform content without express permission.

9. Disclaimer

The materials on CreateEnsemble are provided "as is". CreateEnsemble makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

10. Limitation of Liability

In no event shall CreateEnsemble or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on CreateEnsemble, even if CreateEnsemble or an authorized representative has been notified orally or in writing of the possibility of such damage.

11. Service Availability

While we strive to provide continuous access to our platform, we do not guarantee that the service will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time.

12. Termination

CreateEnsemble may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice, and without liability or obligation to you. Upon termination, your right to use the Platform will cease immediately.

13. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, and you irrevocably submit to the exclusive jurisdiction of the courts located in Boston, Massachusetts.

14. Changes to Terms

CreateEnsemble may revise these terms of service at any time without notice. By using this platform, you are agreeing to be bound by the then current version of these terms of service. We will notify users of significant changes via email or platform announcements.
